1. Acceptance of Terms

By accessing or using Memory Candle (the "Service"), operated by Auri's Ideas, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Memory Candle is an online memorial service that allows users to honor and remember loved ones through:

• Digital Candles: Free virtual candles displayed on our website

• Real Candles: Physical Yahrzeit memorial candles lit on your behalf with photographic or video documentation

3. User Accounts and Age Requirements

Age Requirement: You must be at least 13 years old to use this Service. If you are under 18 years of age, you represent that you have your parent or legal guardian's permission to use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Digital Candles (Free Service)

Digital candles are provided free of charge and displayed on our website for the duration you select (up to 7 days). Digital candles are virtual representations and do not involve physical candles.

You may choose to make your digital candle public (viewable by anyone) or private (viewable only via a share link).

5. Real Candles (Paid Service)

5.1 Service Description

Real candles are physical Yahrzeit memorial candles that we light on your behalf at our facility in Fishers, Indiana, or a nearby location. The cost is $20.00 per candle.

5.2 What We Provide

• Physical lighting of a Yahrzeit memorial candle

• Photographic or video documentation of the candle being lit

• Documentation available in your account for up to 30 days after lighting

5.3 Best Effort Service - Important Limitations

We provide this service on a best-effort basis. While we make every reasonable effort to light candles as requested, we cannot guarantee that every candle will be lit without error. Mistakes, technical issues, unforeseen circumstances, or human error may occur.

We are responsible only for lighting the candle. We are not responsible for:

• How long the candle burns (this depends on the manufacturer)

• Whether the candle stays lit for its intended duration

• Candle quality, burn time, or manufacturer defects

5.4 Refund Policy

No refunds will be issued once a candle lighting has been requested and processed, except in the following circumstance:

If we fail to light your candle as requested, we will issue a full refund of the amount paid ($20.00). This is our sole remedy for service failure.

Refunds will not be issued for dissatisfaction with candle burn duration, appearance, or any issue related to the physical candle itself beyond our failure to light it.

6. User Content and Conduct

You are responsible for the content you submit, including candle names and dedications. You agree not to submit content that:

• Is unlawful, threatening, abusive, harassing, defamatory, or obscene

• Violates any intellectual property rights

• Contains harmful code, viruses, or malicious software

• Violates the privacy or rights of any third party

We reserve the right to remove any content that violates these terms or is otherwise objectionable.

7. Intellectual Property

The Service, including all content, features, functionality, software, and design, is owned by Auri's Ideas, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Payment Processing

Payment processing for real candles is handled securely by Stripe, Inc. We do not store your credit card information. By making a purchase, you agree to Stripe's terms and conditions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Auri's Ideas, LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the specific service giving rise to the claim (maximum $20.00 for real candles, $0 for digital candles).

10. Indemnification

You agree to indemnify, defend, and hold harmless Auri's Ideas, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason. You may terminate your account at any time by contacting us at support@memorycandle.site.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Hamilton County, Indiana, and you consent to the exclusive jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
